Joseph and Mary got married at a big colourful wedding at Namirembe Cathedral in 2010. They worked hard and built a residential home in Bulindo, bought 6 rentals in Nansana and 10 acres of land in Zirobwe.
In 2015 Joseph and Mary developed serious misunderstandings and Mary left to go to Saudi Arabia to work. She did not know that she was two months pregnant. She later gave birth to a baby girl in 2016 while in Saudi Arabia and remained there.
In 2018 Joseph met Sheila and they had a kwanjula the same year. They started living together and gave birth to twins.
Unfortunately, in June 2021 Joseph got COVID and passed away. Mary came for burial and does not want to go back to Saudi Arabia. She wants to go back to their matrimonial home and raise her daughter. She also has applied for Letters of Administration to manage the estate of Joseph. Sheila is protesting and says that she is the lawful widow as Mary had long separated from Joseph and is not entitled to benefit from the estate of Joseph.
Conclusion
The Supreme Court of Uganda in the case of NALUMANSI Vs JOLLY KASANDE & 2 OTHERS has held that a separated widow has an interest in the estate of her deceased husband and has a right to benefit from it if she made a contribution towards accumulation of the property, which contribution can be financial or otherwise.
